This problem also came before a Full Bench of Patna High Court in Fazlur Rahman v. Mst. Aisha (A I R 1929 Pat. 8 1 ). In that case, it was urged by one of the eminent counsels that the functions of the British Courts in administering the Muhammadan Law are more or less the same as the functions of a Qazi under the Muhammadan rule.
